Terms of Service

1. Acceptance of Terms

By accessing and using Hostwise ("the Service," "our platform," or "we"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, you should not use our service.

2. Description of Service

Hostwise is a cloud-based property management platform that provides tools for:

  • Property and asset management
  • Maintenance scheduling and tracking
  • Inventory management
  • User management and permissions
  • Reporting and analytics
  • Vendor management

3. User Accounts and Registration

3.1 Account Creation

To use our service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 User Eligibility

You must be at least 18 years old and have the legal authority to enter into this agreement on behalf of your organization.

4. Subscription and Billing

4.1 Subscription Plans

Our service is provided on a subscription basis. Pricing is based on the number of licensed properties in your account at $5.00 per property per month.

4.2 Billing Cycle

Subscriptions are billed monthly on your account anniversary date. Your first billing date is established when you subscribe to a paid plan.

4.3 Payment Terms

  • Payment is due monthly in advance
  • We accept credit cards processed through Stripe
  • Failed payments may result in service suspension
  • You are responsible for keeping payment information current

4.4 Price Changes

We reserve the right to change our pricing with 30 days' written notice. Price changes will take effect on your next billing cycle.

4.5 Refunds

We do not provide refunds for partial months. You may cancel your subscription at any time, and service will continue until the end of your current billing period.

5. Use of Service

5.1 Permitted Use

You may use our service only for lawful purposes and in accordance with these Terms. You agree not to use the service:

  • In any way that violates applicable laws or regulations
  • To transmit harmful, threatening, or inappropriate content
  • To interfere with or disrupt the service or servers
  • To attempt to gain unauthorized access to other accounts
  • For any commercial purpose outside of your property management needs

5.2 Data and Content

You retain ownership of all data and content you upload to our service. You grant us a limited license to use this data to provide our services to you.

5.3 Service Availability

While we strive for high availability, we do not guarantee uninterrupted service. We may perform maintenance that temporarily affects service availability.

5.4 Messaging and Communications

Actionable messages will be sent by the system to registered users via email and SMS. Marketing and general communications will never be sent by the system via SMS.

 

You can cancel the SMS service at any time. Just text “STOP” to the short code.

 

After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

 

If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at support@hostwise.app.

 

Carriers are not liable for delayed or undelivered messages.

 

As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

6. Data Security and Privacy

6.1 Data Protection

We implement industry-standard security measures to protect your data. However, no system is 100% secure, and you acknowledge the inherent risks of internet-based services.

6.2 Data Backup

While we maintain backups of our systems, you are responsible for maintaining your own backups of critical data.

6.3 Privacy

Your privacy is important to us. Please review our Privacy Policy, which governs how we collect, use, and protect your information. If you have any questions regarding privacy, please read our privacy policy.

7. Intellectual Property

7.1 Our Rights

Hostwise and all related trademarks, logos, and intellectual property are owned by us. You may not use our intellectual property without written permission.

7.2 Your Rights

You retain all rights to your data and content. We do not claim ownership of information you store in our service.

8. Service Modifications and Termination

8.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of our service at any time with reasonable notice.

8.2 Account Termination

Either party may terminate this agreement at any time:

  • You may cancel your subscription through your account settings
  • We may terminate accounts that violate these terms
  • We may terminate accounts with unpaid balances

8.3 Effect of Termination

Upon termination, your access to the service will cease. We will retain your data for a reasonable period to allow for account reactivation, after which it may be deleted.

9. Disclaimers and Limitation of Liability

9.1 Service Disclaimer

Our service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to merchantability and fitness for a particular purpose.

9.2 Limitation of Liability

In no event shall Hostwise be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

9.3 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, internet outages, or government actions.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our service or violation of these terms.

11. Dispute Resolution

11.1 Governing Law

These terms are governed by the laws of Washington State without regard to conflict of law principles.

11.2 Dispute Resolution

Any disputes arising from these terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. General Provisions

12.1 Entire Agreement

These Terms of Service, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Hostwise.

12.2 Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

12.3 Updates to Terms

We may update these terms from time to time. We will notify users of material changes via email or platform notification. Continued use after changes constitutes acceptance of the new terms.
